There are benefits to traders who register under the Motor Vehicle Sales Act 2003 (MVSA).  Some of the benefits of registration are:

  • you are no longer restricted to selling from specified premises
  • your salespersons are not required to be registered or approved
  • there is no compulsory membership in any trade association
  • there are no special warranties in addition to the Consumer Guarantees Act 1993
  • there is no fidelity fund

Who needs to register?

The MVSA sets out the criteria for who must register as a motor vehicle trader.

Who does not need to register, or is unable to register?

If you are a private seller selling your own car to another consumer you are not required to register as a trader. The MVSA only applies to those persons who are carrying on the business of motor vehicle trading.
